TIPO Publishes Case Studies on IT Patent Examination - 2022年02月25日

In order to protect innovation and establish clear standards for patent examination, TIPO has updated Part II, Chapter 12 of the Examination Guidelines for Computer Software-Related Inventions, in response to industry changes. The revisions came into effect on July 1, 2021.

TIPO also provides 20 case studies across the five major fields of IT – AI, IoT, blockchain, cloud applications, and big data – to help applicants better understand the basis on which patent applications are assessed and ensure that patent examiners utilize the same concepts during examination. The compendium of case studies, Case Studies on IT Patent Examination, is available to the public and includes both patentable and non-patentable requests to illustrate, step-by-step, how the patentability of each request is considered.

TIPO Launches Design Patent Priority Document Exchange Program with JPO - 2022年01月05日

The Taiwan-Japan MoU on Electronic Patent Priority Document Exchange (PDX) was signed in 2013, applicable to both invention and utility model patent applications. As the PDX program has been put to extensive use by applicants from both countries since its implementation, an additional MoU on Design Patent Priority Document Exchange was signed in 2019. Upon its implementation, by providing an alternative to mailing paperwork, the PDX program can increase application efficiency and streamline cross-country application procedures. Broadening the scope of the bilateral PDX cooperation has also made the exchange mechanism between Taiwan and Japan progressively comprehensive and robust.

Starting from January 1, 2022, a design patent applicant will be deemed to have filed a priority document if he/she provides an access code issued by the JPO within 10 months after the earliest priority date. The design patent application form and the application instructions have both been amended and provided for applicant use, in conjunction with the forthcoming implementation.

Taiwan and Japan Strengthen Patent Examination Cooperation by Signing the MoUs on Patent Prosecution Highway (PPH) and on Design Patent Priority Document Exchange (PDX) - 2019年10月30日

Today (October 30th), the Taiwan-Japan Relations Association and Japan-Taiwan Exchange Association signed the MoUs on Patent Prosecution Highway (PPH) and on Design Patent Priority Document Exchange (PDX). Through the two cooperative programs, TIPO and the JPO will facilitate more efficient and convenient services for applicants.

In May 2012, TIPO and the JPO launched the PPH pilot program, which was then modified to PPH MOTTAINAI in 2014 and was extended for three years in 2017. As of the end of September 2019, TIPO had received 3,426 requests for expedited examination, outnumbering other five ongoing PPH programs TIPO is currently partnering with. In addition, the pilot program remarkably sped up examination process, with first OA pendency averaging at 1.21 months and disposal at 3.77 months, respectively. In view of its excellent performance, TIPO and the JPO agreed that following the expiry of the pilot program, a permanent PPH program will replace it, starting on May 1, 2020. This permanent program is aimed at continuing to provide applicants with stable and convenient PPH services.

New Guidelines on Inventive Step Examination of Invention Patent in Taiwan - 2018年05月23日

Taiwan Intellectual Property Office (TIPO) announced a new version of Section III “Inventive Step” of Chapter III “”Patentability of Part II “Substantive Examination” of “The Patent Examination Guidelines for Invention Patents”, which is briefly called as “New Examination Guidelines on Inventive Step of Invention Patent” (NEGISIP) hereinafter, and took it effective as of July 1, 2017.

The major issues of the amendment provisions comprises (1) the prerequisites for determination of inventive step, (2) the definition of a person who has general knowledge pertains to in the invention (“person skilled in the art” or “ordinary skilled person”), (3) examination principles for determination of inventive step and so on, (4) examination principles for determination of inventive step, as well as matters concerning examination on inventive step, which are briefly introduced as followings.。(APAA e-Newsletter)...more
